Website and Sale Terms

KoalaCue is operated by LightAttractions Pty Ltd (ABN 90 149 354 450), trading as Koala Cue, in Victoria, Australia. These terms cover your use of this website and any purchase of KoalaCue. Sales are not yet live; the commercial terms below describe how buying will work when it opens.
Acceptance
By using this website, downloading KoalaCue, or buying a plan, you agree to these terms, to the KoalaCue Software Licence Agreement, to the Refund and Cancellation Policy and to the Privacy Policy. If you do not agree, do not use or buy KoalaCue.
Eligibility and authority to buy
You must be able to enter a binding contract. If you buy for a venue, company, school or production, you confirm you are authorised to bind that organisation and that it is bound by these terms. Where a purchase is made in the course of business, business-to-business use of the software is still subject to the consumer rights described below where the law applies them.
Plans and launch prices
KoalaCue is offered as three plans:
- Free — A$0. Cues and view-only Preset Lab. No Recorder or Review.
- Recorder — A$25 per month or A$180 per year. Adds Recorder and Review.
- Full — A$50 per month or A$400 per year. Everything, including editable Preset Lab documentation.
These are launch prices in Australian dollars. Paying annually costs less than paying monthly for the same twelve months: Recorder is A$300 across 12 monthly payments versus A$180 annually, a saving of A$120, and Full is A$600 across 12 monthly payments versus A$400 annually, a saving of A$200. Prices, plan contents and available options may change for new purchases and for future renewal periods; where a change affects your renewal you will be told before it takes effect so you can cancel first.
Checkout, tax and totals
Purchases are completed through a hosted checkout provided by Lemon Squeezy, which acts as merchant of record for the sale. Your contract of sale for payment purposes is with Lemon Squeezy, and its checkout terms and privacy policy apply to that transaction.
Any applicable GST, VAT or other taxes and the final total payable are calculated and shown to you at checkout before you confirm payment. Amounts shown elsewhere on this site are indicative launch prices and are not a substitute for the total shown at checkout.
Automatic renewal and cancellation
Paid plans are subscriptions billed monthly or annually, as you choose at checkout. Both cadences renew automatically at their selected cadence at the then-current renewal price until cancelled, using the payment method held by Lemon Squeezy. You can cancel at any time through the customer portal linked from your receipt, or by emailing info@koalacue.com. Cancelling stops the next renewal; paid access normally continues to the end of the period you have already paid for. See the Refund and Cancellation Policy.
Your account and customer portal
Subscription details, invoices, payment method and cancellation are managed in the Lemon Squeezy customer portal reached from your purchase receipt. Keep your email address current there, because licence and renewal messages are sent to it. You are responsible for activity under your purchase records and for keeping your licence details confidential.
Licence keys and one active Mac
A paid purchase issues a licence key. A paid licence may be active on exactly one Mac at a time. You can deactivate the Mac you are currently using and activate a replacement in its place. Licence keys are personal to the purchaser or purchasing organisation and must not be shared, published, resold or used to give access to unrelated parties. Full details are in the Software Licence Agreement.
Free seven-day trial of Full
Where offered, KoalaCue includes a card-free seven-day trial of Full features. It does not require a card and does not start a subscription. Full access ends at the fixed seven-day expiry, and KoalaCue then returns safely to the Free plan: the app keeps working, your local show files, recordings, notes and documentation are never deleted, damaged, encrypted or hidden, and paid-only features simply stop being available until you buy a plan. We do not promise that the trial can be restarted.
This trial is a separate thing from the seven-day offline window described below. The trial is a one-off seven-day period of Full access for that Mac; the offline window is how long an already-paid licence keeps working without an internet connection.
Licence refresh and offline use
Paid entitlements refresh daily while your Mac is online. Previously validated paid access remains usable offline for no more than seven days from the last successful signed licence check, so a show is not disrupted by a venue with no usable internet. KoalaCue warns you beginning three days before that window expires and shows the time remaining. If it cannot revalidate by the end of the window, KoalaCue returns safely to the Free plan. Connect briefly before a production if you expect to work offline.
If a licence is transferred to another Mac, cancelled, refunded, fails to renew, expires or is revoked, an already-offline Mac can retain paid access only until that signed seven-day window ends. In every case your local show files, recordings and documentation are never deleted, damaged, encrypted or hidden.
Updates
Updates are delivered inside KoalaCue for macOS as complete signed releases, and you choose when to install them. Updates may add, change or remove features. We do not promise any particular future feature, release date or roadmap item, and material described as planned is not part of what you are buying today.
Support
Support is provided by email at info@koalacue.com and through the Companion support page and fault report form. Reasonable efforts are made to answer and to fix genuine faults, but no specific response time, on-site attendance, or show-cover service is promised.
Acceptable use
You must not:
- share, sublicense, rent, resell or publish licence keys, or use them beyond the permitted devices;
- circumvent, disable or tamper with licensing, activation, trial or update mechanisms;
- attack, overload, probe or interfere with this website, the licence service, or the fault intake form, including automated or bulk submissions;
- upload unlawful, infringing or malicious content, or impersonate anyone; or
- use KoalaCue in a way that breaks the law or the terms of ETC, Apple or any other third party whose products you use with it.
Your responsibility for the show
KoalaCue is a companion tool for ETC Eos lighting teams. It is not an ETC product, is not affiliated with or endorsed by ETC, and is not a safety system. You remain responsible for your production: for what is sent to and stored on your console, for your show data and backups, for your network, for cameras, capture devices and audio hardware, and for the safety of people and equipment.
Verify commands and results on the console before relying on them, keep independent Eos and show backups, and test your exact hardware and workflow before a performance. Never use KoalaCue as the only safeguard for anything that could cause harm or loss.
Before you enable cue triggering
KoalaCue can send cue commands to Eos in two ways: manually, after you deliberately enable Run Cues, and automatically, when cue events recorded in a session trigger cues during Review. Both are opt-in, and both put real light, movement and effects into a real room. Cues can involve special effects, atmospherics such as haze or fog, strobes and flashing light, sudden blackouts, moving lights and other potentially unsafe lighting conditions.
Before enabling manual Run Cues or automatic cue triggering during Review, you are responsible for:
- reviewing the cue list and the current playback position;
- verifying the intended Eos target and user, and every piece of connected equipment;
- ensuring a competent, authorised operator is present, that venue risk controls are in place, that any required warnings and exclusion zones are set, and that a working manual override and emergency procedure is available; and
- deciding that every cue and effect that may run is safe and lawful for that venue and for the people present.
The in-app acknowledgement is a reminder, not an inspection: it does not inspect or certify cues, equipment, effects, venue conditions or safety, and it is no substitute for safe professional practice. KoalaCue must not be used as a safety, interlock, emergency-stop or sole control system for hazardous effects.
To the maximum extent the law permits, LightAttractions Pty Ltd is not responsible for the consequences of cues or effects you command, arm or authorise. Nothing in this section excludes, restricts or modifies your rights under the Australian Consumer Law or any other right that cannot lawfully be excluded.
Intellectual property
KoalaCue, its software, artwork, name and logos remain the property of its owner. Nothing in these terms transfers ownership; you receive only the licence described in the Software Licence Agreement. ETC, Eos, Apple, macOS and other names are the trademarks of their respective owners and are used only to describe compatibility.
Your content and imported material
Your shows, recordings, notes, photographs and imported files stay yours. You are responsible for having the rights to any material you import — including GDTF and fixture data, gobo images, photographs, video and audio — and for any consents needed to record people, performances or venues. Do not import material you are not allowed to use.
Third-party services
KoalaCue and this website rely on third parties, including Apple, ETC consoles you connect to, Lemon Squeezy for checkout and billing, and hosting and content-delivery providers. Their own terms and policies apply to their parts, and their availability is outside our control.
Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund and compensation for other reasonably foreseeable loss or damage; for failures that do not amount to a major failure, you are entitled to have the problem fixed within a reasonable time and, if that is not done, to cancel and obtain a refund.
Limits of liability
Subject to the section above, and to the maximum extent the law allows: KoalaCue is provided as is and without any promise that it will be uninterrupted or error-free; we are not liable for indirect or consequential loss, lost profit, lost production time, lost or corrupted show data, or loss caused by your network, hardware, console or third-party services; and our total liability arising out of KoalaCue is limited to the amount you paid for it in the twelve months before the claim, or, where the law permits us to choose, to resupplying the software or paying the cost of resupply.
Suspension and termination
We may suspend or terminate a licence or website access where these terms are seriously or repeatedly breached, where a payment is reversed or a chargeback is made, or where required by law. Where practical you will be told and given a chance to fix the problem. Termination does not delete, damage or hide the local show files, recordings or documentation on your Mac, and it does not affect your Australian Consumer Law rights.
Changes to these terms
These terms may be updated as KoalaCue changes. The effective date above will be revised and material changes described. Continuing to use the website or the software after a change takes effect means you accept the updated terms; if you do not accept them, cancel and stop using KoalaCue.
Governing law
These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia. This does not remove any mandatory consumer right or protection available to you where you live.
